Happiest Health aims to bring together users and advertisers on a single platform creating in the process a unique value proposition for each. These guidelines are a ‘living document’ that shall be continually updated basis user feedback and our evolving ethos and beliefs.
The “Platform” means and includes “HappiestHealth.com”, all micro sites, print media and any other that is currently hosted (or to be hosted) by Happiest Health Systems Pvt. Ltd. (hereinafter ‘Happiest Health’) on social media platforms such as Facebook, YouTube, WhatsApp etc.
Advertising and advertisements shall include banners, modules, links, microsites, and other content provided by the advertiser or his agent.
Acceptance and display of advertisements on the Platform will not be tantamount to endorsement of the products and services advertised. Happiest Health will not be liable for any claims/damages that may arise from any user’s reliance and consequent acts basis the advertisements displayed.
While the Platform strives to not display any advertisements that are not in consonance with this advertising policy, such diligence will not create an enforceable right in favour of any person, nor does it impose any contractual or other obligations, on Happiest Health of strict adherence to terms herein specified.
Happiest Health reserves the right to evaluate each advertisement on a case-to-case basis, independent of this policy.
3.0 RESPONSIBILITIES OF ADVERTISER
Advertisers and agents are solely responsible for the accuracy, objectivity, legality of the contents and the links provided (if any) in the advertisements. Advertisers must have evidence to back their claims.
The advertisers and their agents warrant and undertake full statutory compliance with all the relevant laws, rules and policies governing advertising in the countries/jurisdictions where the said advertisements may be viewed.
The advertiser and agents jointly and severally indemnify and hold harmless Happiest Health as against any expenses/claims that may arise from the publication, including but not limited to claims of libel, privacy violation, copyright infringement, plagiarism, and statutory non-compliance of the relevant advertising laws.
4.0 ADVERTISING GUIDELINES
Happiest Health has the sole discretion to determine the types of advertising to be accepted and displayed. It has the right, but not the obligation to reject advertisements that is incompatible with this policy.
The Platform will not accept advertising that in its opinion is false, factually inaccurate, misleading, or in poor taste.
Happiest Health shall evaluate and where appropriate refuse advertisements that may be, offensive and dangerous, includes material that is visually disturbing or discriminates, attacks, shames any individual or group based on race, gender, religion, marital status, disability, body image, colour or any other factor deemed inappropriate for the Platform.
As “Health and Wellness Evangelists”, Happiest Health strives not to publish advertisements that run contrary to its ethical mission. Happiest Health reserves the right to reject advertisements, that in its discretion, promotes an unhealthy lifestyle, cause obesity, are carcinogenic and may include but is not limited to advertisements that promote alcohol, cigarettes, tobacco, pan masala, fast food, semi-processed/processed, fried or commercially baked foods that are “HFSS” (High in fat, salt and sugar), artificially sweetened carbonated beverages, hydrogenated fats and/or any other such products.
Besides statutorily banned product advertisements such as for alcohol, firearms and explosives, gambling, pornography, the Platform shall also not display surrogate advertising for marketing such products including for alcohol.
Advertisements that promote any lifestyle products/services that are not optimal to healthy living including online gaming or any remedy/cure/programme/dietary supplement whose scientific efficacy is not proved or validated independently or where required by the concerned regulatory authority or advertisements that promote counterfeit products will be declined.
The Platform will not feature advertisements regarding products and services that are detrimental to children’s health and well-being or bear content that is inappropriate for minors to view or carry links with third party trackers or that otherwise solicit information from minors.
Happiest Health reserves the right to periodically review the advertisement’s compliance with all extant laws and this advertising policy. In the event of a breach or a potential breach, the Platform may remove the advertisement and additionally initiate other actions deemed appropriate.
5.0 EDITORIAL INDEPENDENCE
The Platform recognizes and maintains the distinction between advertising and editorial content. The advertised or sponsored content will be labelled as such and identifiable by font style and size to the extent possible.
6.0 RIGHT TO WITHDRAW
Happiest Health reserves the right to decide at any time in its own discretion whether it will accept, reject, cancel, or replace any advertising on the Platform.
Happiest Health does not provide any assurance that advertising will perform error free on the Platform.
